Terms & Conditions.
Company means Foxhills Pallets Ltd.
Customer means the party purchasing or receiving services.
Services means pallet collection, pallet reconditioning and repair, and purchasing solutions for pallets, cardboard and plastics.
Contract means the agreement formed when the company accepts a customer order in writing.
These terms apply to all services. Any customer terms are excluded unless agreed in writing by a director.
A contract is formed when we issue written confirmation of your order or schedule the service.
Quotations remain valid for thirty days unless stated otherwise.
Dates and times for collections and deliveries are estimates only.
The company may refuse or suspend service where access is unsafe, items are hazardous or prohibited, or information provided is inaccurate.
Pallet grades are supplied to industry norms. Reconditioned pallets meet safe and serviceable standards appropriate to their grade.
Environmental handling and recycling are carried out in line with applicable UK regulations.
The customer must provide accurate weights, dimensions, grades and quantities.
Safe and unobstructed access for vehicles and handling equipment must be ensured.
Hazardous or contaminated items must not be supplied.
Pallets made available for collection must be stacked safely and free of embedded foreign objects.
For repair work, any prior damage or modifications that could affect safety must be disclosed.
Prices are as quoted or per the company rate card at the time of order.
All prices are exclusive of VAT.
Unless otherwise agreed, payment terms are thirty days from invoice date.
Late payment interest accrues at the Bank of England base rate plus eight percent per annum, together with reasonable recovery costs.
The company may withhold or suspend services for overdue accounts.
Title to pallets sold transfers to the customer upon full cleared payment.
Risk passes on delivery to the customer or collection by the customer.
The company has a general lien over customer goods in its possession for all sums due.
Goods may be sold after reasonable notice to recover amounts owed and costs of sale, with any surplus accounted to the customer.
The company will provide services with reasonable skill and care.
The company is not liable for loss arising from inaccurate information, inadequate packaging or stacking, inaccessible or unsafe sites, or events beyond its control.
For direct loss or damage, the company’s total liability per contract is limited to the lower of the cost of repair, the cost of replacement on a like for like basis, or the limit of the company’s applicable insurance policy.
The company excludes liability for loss of profit, loss of business, or any consequential or indirect loss.
Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
Reconditioned pallets are inspected and repaired to the stated grade.
Natural variations in timber are expected.
Any agreed returns must be authorised in writing.
The customer is responsible for the condition and safe return unless the return is due to a proven defect.
Damage or discrepancies in quantity or grade must be reported within two working days of delivery or collection.
Formal claims must be submitted within fourteen days with supporting evidence including photos, delivery notes, order references and weights or dimensions.
Claims made outside these periods may be rejected if investigation is prejudiced.
Orders cancelled by the customer within twenty four hours of a scheduled slot may incur a callout or restocking charge.
If the company cannot perform the service it will offer a new slot.
If performance remains unfeasible, fees paid for the affected service will be refunded.
The customer warrants that goods supplied for collection are lawful to transport and process.
Waste transfer notes and any required documentation will be completed accurately by both parties.
The company may reject items that are contaminated, unsafe or non compliant.
The company is not liable for delay or failure caused by events beyond reasonable control including severe weather, industrial action, utility failure, road closures, vehicle breakdown, accidents or regulatory action.
Personal data is processed in accordance with the company privacy notice available on request or on the website.
Operational data such as locations, weights and grades may be retained for legal and audit purposes.
These terms constitute the entire agreement for the services and supersede prior understandings.
If any provision is held invalid, the remainder remains in force.
No variation is effective unless in writing and signed by an authorised representative.
Governing law and jurisdiction is England and Wales.
